A Gibraltar gambling licence is a formal authorisation issued by the Gibraltar Gambling Commissioner, permitting a company to operate casino, betting or gaming services from Gibraltar. It is one of the oldest licensing regimes in the online gambling industry, with the territory issuing its first online gaming licences back in 1998, long before most of today’s regulators existed in any recognisable form.
The Regulator Behind the Licence
The Gibraltar Gambling Commissioner sits within the Gambling Division of HM Government of Gibraltar and handles the day-to-day supervision of every licensed operator, monitoring compliance, investigating complaints and enforcing the conditions that come with holding a licence. Issuing and cancelling licences technically falls to the Licensing Authority, the Minister responsible for gambling, but the Commissioner is the office operators deal with in practice, and the one the industry’s reputation rests on.
The Legal Framework
For two decades, Gibraltar’s gambling industry answered to the Gambling Act 2005. That framework was replaced by the Gambling Act 2025, which passed through Gibraltar’s Parliament in March 2026 and came into force on 1 April 2026. The new Act moves away from licensing individual entities and towards regulating activities directly, meaning a company can now fall under Gibraltar’s regulatory reach simply by performing a regulated function connected to a Gibraltar licence holder, even if that company isn’t based in Gibraltar itself.
What a Licence Actually Covers
Under the 2025 Act, the Commissioner issues three categories of licence. A B2C Gambling Operator’s Licence covers companies offering casino games, betting or gaming directly to players. A B2B Gambling Operator’s Licence covers suppliers providing software, platforms or content to other licensed operators. A newly introduced Gambling Operator Support Services licence, usually shortened to GOSS, brings marketing services and the ownership structures behind gambling businesses under the Commissioner’s oversight for the first time.
Why the Licence Matters
Holding a Gibraltar licence is not a formality. Applicants need a demonstrable track record in the gambling sector, a viable business plan and, since the 2025 Act, genuine corporate substance in Gibraltar itself — real office space, real staff, and enough capital to cover player winnings and operating costs. The Commissioner can now issue administrative penalties, cease-and-desist orders, suspensions or prohibition orders for non-compliance, a more graduated set of tools than the 2005 Act’s effectively binary choice of revoke or do nothing.
